The agreement between you and Foodies: what you may post, what happens when somebody behaves badly, how the optional Pro subscription works, and who is responsible for what. Short, and in plain language, because terms nobody reads protect nobody.

1. Who this agreement is with
Foodies is operated by Hugo Moriceau, trading as Foodies, Paris, France. By creating an account or using the app or this website, you agree to these terms. If you do not agree with them, do not use Foodies.
Contact for anything in this document: hugo@oshi-messenger.com, or the contact form. How we handle personal data is set out separately in the privacy policy, which forms part of this agreement.
2. Your account
You must be at least 13 years old to use Foodies. If the law where you live sets a higher age for consenting to online services on your own, you must meet that age or have your parent or guardian's permission.
You can browse the feed and Explore as a guest. To post, comment, like, save, follow, message, host an event or RSVP to one, you need a full account, which is created with Sign in with Apple. That is enforced on the server, not only in the interface: a guest token cannot perform those actions however it is used.
- Keep your device and your Apple Account secure; activity from your signed-in device is treated as yours.
- Usernames are lowercase letters, digits, underscores and dots, up to 24 characters, and must be unique. We may reclaim a username that impersonates somebody, infringes a trade mark, or is used to squat.
- One person, one account, where the account is used to interact with others. Do not create accounts to evade a block, a removal or a ban.
- Do not sell, rent or transfer your account.
3. Acceptable use
The short version: post food, be a person, and do not use Foodies to hurt anyone.
Specifically, you agree not to post, send or host:
- Content that sexualises minors, in any form. This is the one rule with no context, no nuance and no second chance; we report it and delete the account.
- Slurs and hate directed at people for who they are, threats of violence, harassment campaigns, or content that incites either.
- Sexually explicit material, gratuitous gore, or content designed to shock.
- Content you do not have the right to post, someone else's photographs, recipes copied wholesale from a book or another site, trade marks used to impersonate a brand.
- Spam: bulk or repetitive posting, engagement schemes, link farms, or automated posting. Our server rejects text made of a single repeated character and posts carrying three or more links.
- Impersonation of another person, chef, restaurant or business.
- Anything unlawful, or anything that promotes dangerous food practices presented as safe.
You also agree not to attack the service itself: no scraping at scale, no attempts to break authentication or access another person's data, no reverse engineering of the app beyond what applicable law permits, no probing our rate limits, and no reselling access to the API.
4. Your content, and what we may do with it
Your photos, videos, recipes, captions and comments remain yours. Foodies claims no ownership of anything you make.
To be able to run the service at all, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, re-encode, resize, cache and display your content, and to distribute it to the people the app is designed to show it to. That licence exists for one purpose, operating and improving Foodies, and it ends when you delete the content or your account, apart from copies that remain in a routine backup until it ages out. We do not licence your content to advertisers and we do not sell it.
Two practical consequences worth stating. First, every uploaded photo and video is re-encoded on our server into a compact, uniform format, so the file we serve is not byte-identical to the file you took. Second, a public post can be seen by anyone, including people who have not signed in; setting your account to private keeps your posts out of Explore, Trending, Nearby and search.
If you believe content on Foodies infringes your copyright, write to hugo@oshi-messenger.com identifying the content, the work it infringes, and your right to act. We remove infringing material and repeatedly-infringing accounts.
5. Moderation, reporting and blocking
There are three layers, and we would rather describe the ones that exist than promise a trust-and-safety department we do not have.
Automated screening, before anything is published
Titles, captions, comments and collection names are checked on the server before they are stored. The filter is deliberately narrow and high-precision: it rejects slurs, child-sexual-abuse terminology and explicit threats of violence, plus structural spam. It is not a general profanity filter and it is not a substitute for the two human layers below. It does not apply to direct messages, because those are end-to-end encrypted and we cannot read them.
Reporting
Any post or account can be reported from the app, with a reason. Reports are recorded and reviewed by a person. We may remove content, restrict an account, or terminate it. If we remove something of yours and you ask why, we will tell you.
Blocking
Blocking an account is symmetric and enforced on the server, not just hidden in the interface: once a block exists in either direction, neither of you can follow the other, comment on the other's posts, like them, start or continue a conversation, or appear in the other's visitor list. Existing follows in both directions are removed at the moment you block. You can see and undo your blocks in Settings.
Zero tolerance for objectionable content and abusive users. We remove content that breaks section 3 and we terminate accounts that keep breaking it, usually within 24 hours of a report reaching us. Evading a termination with a new account is itself a breach.
6. Live cooking events
Anyone with a full account can schedule and host a live cooking event. While you are broadcasting you are publishing in real time to everyone watching, and everything in section 3 applies to what is in frame and what you say. Live chat is public and stored as ordinary text so people arriving late can read the thread, it is not encrypted.
Broadcasts are length-capped and a stream that runs past the cap is closed automatically. We may end a broadcast that breaches these terms, and we may remove the recording.
7. Foodies Pro and billing
Foodies is free. Posting, following, messaging, saving and browsing cost nothing and carry no advertising. Pro is an optional subscription that adds a longer history of who visited your profile and a set of insight screens about your own posts.
- Apple handles the money, not us. Purchases are made through the App Store with your Apple Account. We never see or hold your card details. We receive a signed receipt from Apple and verify it before unlocking anything.
- Plans. A monthly plan, a yearly plan that begins with a free trial period, and a one-time lifetime purchase. The exact price in your currency, and the exact trial length, are shown in the app before you confirm, that screen is the authoritative one, because prices differ by territory.
- Renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Apple charges the account within 24 hours of the period end.
- Cancelling is done in the App Store, not with us. Open Settings on your device, tap your name, then Subscriptions, and cancel there. We have no ability to cancel a subscription on your behalf. Cancelling stops the next renewal; the entitlement then lapses on its own when the paid period ends.
- Refunds are Apple's decision. Request one through Apple's report-a-problem process. Any unused part of a free trial is forfeited when you buy a subscription.
- One purchase, one account. The entitlement is bound to Apple's original transaction identifier for your purchase. The same receipt will not unlock a second account.
- Nothing essential sits behind Pro. If you never subscribe, you can still post, follow, message, save, host events and use every social feature.
8. Licence and EULA
We grant you a personal, non-transferable, non-exclusive, revocable licence to use the Foodies app on Apple devices you own or control, for your own non-commercial use, in accordance with the App Store Terms of Service.
Use of the app is additionally governed by Apple's standard Licensed Application End User License Agreement: apple.com/legal/internet-services/itunes/dev/stdeula. That EULA is the one linked from our App Store listing and from Settings inside the app. Where it and these terms conflict on a matter it covers, the EULA governs. Apple is not a party to this agreement and has no responsibility for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of it and may enforce it against you.
9. Ending the agreement
You can leave at any time. Settings → Delete account removes your account and everything attached to it, in one operation, without emailing us. Deleting the app alone does not delete your account.
We may suspend or terminate an account that breaks these terms, that puts other people at risk, or that we are legally required to remove. Where it is proportionate and lawful to do so, we will warn first. Sections on content licences already granted, disclaimers, liability and governing law survive termination.
10. Disclaimers and liability
Foodies is provided as it is. We do not promise the service will be uninterrupted, that every feature will always work, or that content posted by other people is accurate.
Food is not risk-free. Recipes, techniques, timings and guidance on Foodies, including the cooking guides on this website, are shared for general information. They are not professional dietary, medical or food-safety advice. You are responsible for checking allergens, for cooking food to a safe temperature, and for judging whether something is suitable for you and the people you feed.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data beyond what our backups hold, or for content posted by other users. Where we are liable, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty euros.
None of the above limits liability that cannot be limited by law: death or personal injury caused by negligence, fraud, or the statutory rights you have as a consumer under French and EU law, including the legal guarantee of conformity. Those rights apply whatever this document says.
11. Governing law and disputes
These terms are governed by French law. If you are a consumer resident in the European Union, you also keep the protection of the mandatory rules of the country you live in, and you may bring proceedings in the courts of that country.
Before going to court, please write to hugo@oshi-messenger.com. Almost everything is a misunderstanding that a reply fixes, and we would rather answer you than litigate.
12. Changes to these terms
We may update these terms as the product changes or the law does. The date at the top always reflects the current version, and material changes are announced in the app before they take effect. Continuing to use Foodies after that is acceptance; if you do not accept, delete your account.
